Refund policy

Spark Cart Learning (Spark Cart Sp. z o.o.) · spark-cart.com

Effective date: 12 October 2026

This policy explains your rights if you change your mind or if a file you bought from us is faulty. Your statutory consumer rights always apply, and nothing in this policy limits them.

In short

  • Our English packs are digital downloads. You lose the 14-day right to change your mind once the download is made available, because you agreed to that at checkout.
  • If a file is faulty, incomplete, not as described or not delivered, we fix it, replace it or refund you.
  • Contact us at info@spark-cart.com with your order number.

1. Your 14-day right of withdrawal, and when it ends

As a consumer buying online, you normally have the right to withdraw from a contract within 14 days without giving a reason.

For digital content not supplied on a physical medium, this right ends once delivery has begun if:

  1. you gave your express, prior consent to receive the content immediately, before the 14-day period ends;
  2. you acknowledged that you lose your right of withdrawal as a result; and
  3. we confirmed your consent and acknowledgement to you by email, in your order confirmation.

This follows art. 38 ust. 1 pkt 13 of the Polish Consumer Rights Act of 30 May 2014 (ustawa o prawach konsumenta) and Article 16(m) of Directive 2011/83/EU.

Before you pay, we ask you to tick this box, which is never ticked in advance:

I request immediate access to the digital content and agree that delivery starts before the 14-day withdrawal period ends. I understand that I lose my right of withdrawal once delivery begins.

Once you tick the box and complete your order, your download is made available straight away by email and on the order confirmation page, and from that moment the right of withdrawal no longer applies. Your rights if a file is faulty (section 2) are not affected.

If you did not give this consent, or we did not confirm it to you, you keep your 14-day right of withdrawal. Email us to withdraw and we will refund you in full within 14 days. In that case, please delete the files and do not share them.

2. Faulty, incomplete or undelivered files

Our packs must match their description and work as they should: the files must open, be complete, and match the contents, level and format described on the product page. We are responsible for this for 2 years from delivery.

If something is wrong, for example a file that will not open, missing pages, the wrong product, a download that never arrived, or content that does not match the description:

  1. We fix it first. We send a corrected file or a working link, free of charge and within a reasonable time.
  2. Price reduction or refund. You can ask for a price reduction, or withdraw from the contract and get a full refund, if we cannot or do not fix the problem, if the fix fails, if the problem is serious enough to justify it straight away, or if it is clear we will not fix it within a reasonable time or without significant inconvenience to you. You cannot withdraw for a minor defect.
  3. Refund timing. We refund without undue delay and no later than 14 days after we receive your request, to your original payment method.

If you get a refund for a faulty file, please delete the files and do not share them.

These rights come from art. 43h–43q of the Polish Consumer Rights Act and Directive (EU) 2019/770.

3. Free sample lesson

Our free sample lesson costs nothing, so there is nothing to refund. If the file is broken or incomplete, tell us and we will fix or replace it. Getting the sample never depends on agreeing to marketing emails.

4. How to ask for a fix or refund

Email info@spark-cart.com with:

  • your order number (in your order confirmation email);
  • the email address you used for the order;
  • what the problem is, or that you wish to withdraw; and
  • for a faulty file, a short description or screenshot of the error.

We reply to every complaint within 14 days. If we do not reply within 14 days, your complaint is treated as accepted. More detail on complaints is in our Terms of Service.

5. Sole traders

If you are a sole trader buying for a purpose that is not professional for you (judged in particular by the activities in your CEIDG entry), you have the same rights under this policy as a consumer, under art. 7aa of the Polish Consumer Rights Act.

6. Out-of-court dispute resolution

If we cannot resolve a problem together, you can contact your local consumer ombudsman (rzecznik konsumentów) or use the amicable dispute resolution bodies listed by the Polish Office of Competition and Consumer Protection (UOKiK) at polubowne.uokik.gov.pl. Consumers in other EU countries can find their national bodies at consumer-redress.ec.europa.eu. The EU online dispute resolution (ODR) platform closed on 20 July 2025.

This document is available in English and Polish; both language versions have equal force. In case of any discrepancy, the interpretation more favourable to the consumer applies.
