2. Definitions

  • Consumer: a natural person buying for purposes not related to their business or profession.
  • Digital products: our English-learning packs supplied as PDF or ZIP downloads.
  • You: the person placing the order.

3. Products

We sell digital English-learning materials (self-study packs, workbooks and bundles) delivered as downloadable files. Each product page describes the contents, level, number of pages and file format. The files are PDFs (bundles may be ZIP archives) and can be opened on any computer, tablet or phone with a standard PDF reader. You need an internet connection and an email address to receive them.

4. Licence for personal use

When you buy a pack, you get a non-exclusive, non-transferable licence to use it for your own learning. You may download it, keep copies on your own devices and print it for your own use.

You may not resell, share, publish, upload or distribute the files, or use them for paid teaching or with groups, unless we have agreed this with you in writing. All content remains the intellectual property of Spark Cart Sp. z o.o. or its licensors.

5. Prices

Prices are shown in Polish złoty (PLN). Prices shown in our online store are the final prices you pay. Spark Cart Sp. z o.o. is exempt from VAT under Article 113(1) of the Polish Act of 11 March 2004 on Goods and Services Tax, so prices do not include VAT. The price shown at checkout is the total you pay. There are no delivery charges for digital products. The price that applies is the one shown when you place your order. If we show a price reduction, we also show the lowest price from the 30 days before the reduction.

6. Placing an order and payment

  1. Add products to the cart and go to checkout.
  2. Enter your email address and the details requested.
  3. Tick the consent box for immediate delivery of digital content (see section 8).
  4. Pay using one of the methods offered at checkout. Payments are processed securely by our payment providers, including Shopify Payments.

The contract is concluded when we confirm your order by email after payment is received.

7. Delivery

Digital products are delivered by download. Once your payment is confirmed, your download link appears on the order confirmation page and is sent to your email address, normally within a few minutes. If you do not receive it within 24 hours, check your spam folder and then email us.

8. Right of withdrawal

As a consumer, you normally have 14 days to withdraw from a distance contract without giving a reason.

For digital content not supplied on a physical medium, the right of withdrawal ends once delivery begins if, before delivery, you expressly agreed to immediate delivery and acknowledged that you lose your right of withdrawal, and we confirmed this to you by email (art. 38 ust. 1 pkt 13 of the Polish Consumer Rights Act of 30 May 2014; Article 16(m) of Directive 2011/83/EU). We ask for this consent with a checkbox before payment.

If you did not give that consent, you can withdraw within 14 days of the contract by emailing info@spark-cart.com with a clear statement. We will refund all payments within 14 days of receiving your statement, using your original payment method. Full details are in our Refund Policy.

9. Complaints (reklamacje)

We are responsible for making sure our digital products conform to the contract. If a file is faulty, incomplete, not as described or not delivered, email info@spark-cart.com with your order number, a description of the problem and what you would like us to do.

We reply to every complaint within 14 days of receiving it. If we do not reply within that time, your complaint is treated as accepted. Your rights include having the problem fixed, a price reduction, or withdrawal from the contract with a full refund, as set out in art. 43h–43q of the Polish Consumer Rights Act and in our Refund Policy.

10. Sole traders

If you are a sole trader buying for a purpose that is not professional for you, you have the consumer rights described in sections 8 and 9 (art. 7aa of the Polish Consumer Rights Act).

11. Personal data

We process your personal data as described in our Privacy Policy.

12. Out-of-court dispute resolution

If we cannot resolve a complaint together, you can get free help from your local consumer ombudsman (rzecznik konsumentów) or use an amicable dispute resolution body, such as the Trade Inspection (Inspekcja Handlowa) consumer mediation. The list of bodies is at polubowne.uokik.gov.pl. Consumers in other EU countries can find their national bodies at consumer-redress.ec.europa.eu. The EU online dispute resolution (ODR) platform closed on 20 July 2025, so it is no longer available.

13. Governing law

These terms and contracts made under them are governed by Polish law. If you are a consumer living in another EU country, you keep the protection of the mandatory consumer laws of your country. Consumers may bring claims in the courts allowed by law, including those of the place where they live.

14. Changes to these terms

We may change these terms, for example when the law or our products change. The terms that apply to your order are the ones published when you placed it.
